Accomodation policy

In order to ensure a pleasant stay and avoid any misunderstandings please read Germano cottages Accommodation Policy. This is the standard accommodation policy which applies to direct reservations at Gemano cottages. By confirming a reservation, the Guest fully and unconditionally accepts the terms of this Accommodation Policy, as they have been defined by the owner of the Residence:

  1. Reservation procedure -The reservation is made by the client through the special procedure followed at the website of Germano cottages, by the choice of specific steps which guide effectively the client to the definition of preferences of his/her reservation. The inscription of the correct details of reservation (date of arrival and departure, number of guests, other amenities etc.)
  2. In case of mistakes which are not to be corrected in time, no responsibility is borne by Germano cottages.
  3. Period of accommodation – The minimum period of accommodation is four weeks, for an extension of the period of accommodation; visitors should have in mind that they must consult with the management for further arrangements.
  4. Payment Procedure – For the reservation to be confirmed, it is necessary that the Visitors proceed to the payment of the 40% of the rent 30 days prior to the arrival date. The payment shall be made with any of the payment methods referred to the Website of Germano cottages. The rest of the rent has to be paid strictly at the date of arrival. If we do not receive the above mentioned payments by this time, the pre-reservation or/and the reservation may be cancelled and the initial payment forfeited. You may also be liable for the balance of the total rent and for any other costs involved in the attempt to re-let the accommodation. Alterations to the prices shall be allowed only after written accordance by both parties, or in case of any changes of exchange rate, or in case of one-off tax or in case of any other lease fee.
  5. Alteration by You – If you wish to alter your reservation (e.g. change the dates of your stay or the accommodation requested), we will use all our reasonable efforts to comply with your request, however we cannot guarantee that we will be able to do so and we accept no liability for any loss, damage or additional expense that may be incurred in that circumstance. Delayed arrivals and early departures will be treated as cancellation, even if additional nights are added to the end or beginning of the stay, and so will be subject to the cancellation charge, as it is defined at the cancellation section. If your stay is reduced in length please see the section on Price bands for information on the price you will be charged.
  6. Cancellation by You – All notification of cancellation must be made in writing by post, fax or email to us. You are responsible for ensuring the notification has been received. The cancellation charge imposed varies dependently to the specific time that the cancellation demand is received by us.
  7. When notification is received in no less than 15 days prior before the date of reservation is made, all payments received from the client are refunded.
  8. When notification is received in no more than 60 days or less prior to the first date cancelled, the 50% of the prepayment effected will be refunded.
  9. When notification is received in no more than 30 days or less prior to the first date cancelled, the prepayment effected will not be refunded.
  10. At any other occasion, the amount of payment made till that moment, will not pre-refunded. Transfer of the reservation is allowed only after written consent of the Host of the Residence. Any other alteration without the previous consent of the Host of the Residence will not be recognized nor will produce any effects. The Host is not obliged to recognize such alterations.
  11. Cancellation by Us – In exceptional circumstances we may find it necessary to cancel your booking and if so, we shall make all reasonable efforts to offer a suitable alternative. If this is not acceptable, and assuming the cancellation is not as a result of events beyond our reasonable control, which shall include but not be limited to events such as war, civil strife, terrorist activity, labor disputes, natural or man-made disaster, fire, flood, and adverse weather conditions, we will refund any sum you have paid to us which shall constitute full and final settlement of any liability we may have to you as a result of such cancellation. This does not affect your statutory rights. More specifically, nothing in these conditions shall restrict our liability for death or personal injury caused by our negligence, or for fraudulent misrepresentation.
  12. Alteration by Us – While every effort is made to adhere to the cottages location, postal number and price stated in a booking. We reserve the right to vary the location and postal number of the apartment at any time until check-in and vary the total price at any time before receiving the final payment from the client. Any variation will be communicated to the client in writing by email, post or fax. On receiving notification, the client has forty-eight hours to communicate non-acceptance of the variation described. If no such communication is received, the client is assumed to have accepted the variation. If communication of non-acceptance is received within forty-eight hours, all paid funds will be returned to the client without any deduction.
  13. ID-Passport– Upon arrival the Guest is required to show the original copy of their ID/Passport to the Host. In case the Host needs to keep the Guest details for their records they are obliged to take a photo on the spot and return the documents to the Guest.
  14. Check-in and Check-out – The rules for check-in and check-out are set by us. All cottages are usually available for occupation after 14:00 hours on the Day of arrival. Keys are made available during working hours (between 10:00 hours and 5:00 p.m.). Arrangements can be made for key collection after hours and on Sundays, subject to prior arrangement. All cottages must be vacated by 10:00 hours on the day of departure and keys must be handed over to the reception. Arrangements can be made for a later checkout but this is subject to prior arrangement. Additional charges may apply.
  15. Cleaning-The rooms are cleaned and the sheets and towels change every 2 days, subject to prior arrangement with Visitors.
  16. Children– Children are welcome at the cottage. Infants 2 years and below sharing bed with the parents will not be charges.
  17. Number of Occupants – You are responsible for ensuring that the cottage is not occupied by more people than is stated on your Booking Confirmation email, which is set to the number of beds in the apartment. We reserve the right to refuse admittance to the cottage if we feel this condition is likely to be breached. In this case no paid funds will be returned. The cottages cannot be re-let/sublet to any other group/party without the written approval of us. Additional charges may apply.
  18. Pets– Pets are not allowed in or on the cottage grounds. The Guest is not allowed to bring any pets without prior consent and approval of the Host. The Guest shall be responsible for all damage caused by their pet. If the Guest violates the no-pet policy, the Host has the right to forfeit an additional cleaning fee, cancel the rental agreement without any refund or apply extra charges. Only after the previous consent of the Host and the definition of the exact number and species of pets which are to be hosted, as well as after the prepayment of any addition charges, pets can be allowed on the cottage grounds.
  19. Additional services– Additional services are specified in the booking sheet. In case that the Guest requests for such services, this is possible only after the prepayment of any extra charges.
  20. Rental Rates– Event hosting, food supplies, drinks, bottled water or any other supplies are NOT included in the rental price unless otherwise agreed with the Host.
  21. During the stay-The Host reserves the right to enter the property for inspection at all times with reasonable warning/notice to Guest. Supporting personnel (maids, gardener, pool maintenance etc.) will enter the property at pre-agreed times. The Host can enter the Residence without notice to the Guest when there is reason to believe that the cottage or Guest is in danger or that the Guest violated the Property rules.
  22. Safety & Insurance Issues– The Guest are responsible for (and recommended to procure) their own insurance coverage against theft, personal accidents, trip cancellation etc. The Guest acknowledges that Germano cottages insurance may not cover, thus Germano cottages and the Host assume no responsibility for: accidents, injury, death or loss, including consequential damages from the Rental and use of its facilities, loss or damage of personal property including vehicles and valuables due to fire, theft, vandalism, rain, water, criminal or negligent acts of others, or any other cause, by the Guest or their invitees. By confirming a reservation and accepting this Policy, the Guest agrees to fully legally waive any future claim against Germano cottages and the Host in case such an event occurs.
  23. Valuables– Although our staff is highly reliable and the area is quite safe, valuables shall be left at the Accommodation at Guest’s own risk. Germano cannot be held responsible for any potential loss or damage of personal items. If provided, security alarm should be activated, and safes used. You should make sure to have all doors and windows closed and locked when leaving the accommodation. In the event of any theft or damage occurring through Guest’s negligence, the Host reserves the right to ask compensation from the Guest. In case you vacate the property owing to a burglary, no refund shall be given.
  24. Loud music and parties –Loud music and parties are strictly prohibited. Guests in the Residence should be aware that if loud music is played, or a party is held, and the neighbors complain and/or police are called, you may be immediately removed from the cottage regardless of the time, day or night. In case that the Guest wishes to host any special occasion during his accommodation, he is obliged to inform the Host in advance.
  25. Long absence– If absent from the cottage for longer than two (2) days, please notify the Host.
  26. Possible Damages-Guests are expected to use common sense and caution not to jeopardize the integrity of the Property and structures or expose them to fire, explosives, flammable or pressurized liquids (e.g. scuba tanks, oxygen bottles, liquefied gas bottles, etc.). In case of such damage, Guests will be held legally liable for such damages and charges shall be pressed according to the Kenyan Law. You are responsible for taking all reasonable care of the property and its contents. The property and all equipment, utensils, furniture etc. must be left clean and tidy at the end of the hire period. Except in the case of normal wear and tear the hirer will be responsible for making good any damage to the cottages or its contents, which has occurred due to negligence, willful damage or irresponsible behavior on the part of those occupying the cottage or their guests. Such damage must be reported, without delay, to our local representatives. The cost of the repair or replacement must be agreed with, and paid to, us. You are responsible for ensuring that no person staying or visiting the cottage during your stay will suffer anything to be done which would endanger the policy of our insurers in respect of the cottage and its contents which might make the same void or voidable.
  27. Damage to cottage suite– At the day of departure, the Guest is obliged to invite the Host to check in their presence all areas of the cottage as well as the cottage equipment for any damages. The Host shall inspect the Property, Property surroundings and equipment and if no damages have been made, the full sum of the security deposit is given back to the Guest within five (5) days of the Guest confirmed departure date. The Guest who causes damage to the cottage on purpose or by accident will have to make restitution for the full amount of damage. In the event that the Host notices damages to the property, property surroundings and/or property equipment the cost of repair/replacement is withheld from the security deposit, In case the resulting repair/replacement costs exceed the amount of the Breakage Deposit, the Breakage Deposit is withheld in full and the additional amount is charged to the Guest. Properties are expected to be handed over tidy and clean. An extra cleaning fee may be subtracted from the Breakage Deposit if the property is left excessively dirty or a mess. In case no Breakage Deposit has been held, all damages evaluated to more than 50 EUR may be required to be paid by the Guest prior to their departure. All unreported damages will be charged to the Guest’s credit card or if not possible, will be claimed afterwards in a lawsuit against the Guest.
  28. Unsuitable conduct– The Guest, on signing the contract at check-in agrees to behave responsibly and correctly on behalf of their accompanying party as well as themselves. If this person or any of the accompanying party behaves in an unsuitable and incorrect manner, Germano cottage reserves the right to ask the person and their accompanying party to leave the cottage. Furthermore, from that moment on they will have no right to future claims or any form of compensation. Finally, the Guest will lose all payments made including the apartment rental and the deposit.
  29. Termination by Us – We have the right to terminate a booking at any time on the grounds of abuse to staff or other guests, mistreatment of the apartment or criminal activity on the part of those occupying the apartment or their guests.
  30. Early Departure– In case you leave the Residence earlier than the scheduled date of departure, the payment must include the total pre-agreed amount.
  31. Full Payment– If the full price of the reservation has not yet been paid before the arrival, the payment must be complete within 24 hours since the time of the arrival, unless it has been agreed differently.
  32. Force Majeure – We will not be liable for any delay, loss, damage or expenses incurred if your booking needs to be altered or cancelled or we are unable to perform our contractual obligations as a result of events beyond our reasonable control, which shall include but not be limited to events such as war, civil strife, terrorist activity, labor disputes, natural or man-made disaster, fire, flood, and adverse weather conditions.
  33. Insurance – The cottage hire cost does not include any personal insurance cover of any kind. It is recommended that insurance be taken out against cancellation. It is further strongly advised that personal accident and medical insurance is also taken out.
  34. Smoking – Smoking is not permitted in the apartments or in the internal communal areas of the cottage blocks.
  35. Acceptance of Terms– May we remind you that on booking a cottage with Germano cottages you automatically accept our Terms and Conditions, which we expect you to comply with. You will also have to sign these Terms and Conditions at check-in on the day of your arrival.
  36. Litigation – In the event of any litigation arising from the booking of accommodation with us, the Courts of Kenya shall have sole jurisdiction on such arising matters and Kenyan law prevalent at the time shall be applied at the times.
  37. Complaints – The cottage is maintained to the highest standards. Should you experience any difficulties during your stay, we will do our utmost to assist and solve the problem as soon as possible. If, however, you feel the need of reporting the issue, please do not hesitate to contact the Host. Complaints will be considered only if they have been reported during the stay. Subsequent complaints will not be taken into consideration. The Host cannot be held responsible for noise or disturbance originating beyond the boundaries of the Property or for any disturbance beyond the Host’s control.
  38. The photos of the interior and exterior of the COTTAGE show the current state of the Residence.
